Terms of Service

1. Acceptance of Terms

By accessing or using Psycontext ("the Service"), operated by Psycontext ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Psycontext is a software-as-a-service platform that enables mental health professionals ("Therapists") to gather anonymous contextual feedback from individuals in their patients' social circles ("Respondents") through structured surveys. The Service is designed as a clinical support tool and does not provide medical advice, diagnosis, or treatment.

3. Eligibility

The Service is intended for licensed mental health professionals. By creating an account, you represent that you are a qualified professional authorized to provide therapy or counseling services in your jurisdiction, or that you are using the platform under the supervision of such a professional.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must promptly notify us of any unauthorized use at support@psycontext.com. You are solely responsible for the mapping between patient codes and real patient identities, which must be maintained outside of the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to identify anonymous survey respondents
  • Share survey links with individuals without the patient's informed consent
  • Store real patient names, diagnoses, or protected health information within the platform
  • Use the Service to harass, stalk, or harm any individual
  • Attempt to circumvent security measures or access other users' data

6. Patient Consent

You acknowledge that you are responsible for obtaining appropriate informed consent from your patients before distributing survey links to individuals in their social circles. The Service provides tools to facilitate this process, but the legal and ethical responsibility for consent remains with you as the treating professional.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Survey response data is automatically deleted 15 days after a survey is closed. You are responsible for exporting any data you wish to retain before this automatic deletion occurs. We do not collect identifying information from survey respondents.

8. Subscription and Payment

The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually. You may cancel at any time, and cancellation takes effect at the end of the current billing period. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

9. Intellectual Property

The Service, including its design, code, templates, and content, is owned by Psycontext and protected by intellectual property laws. You retain ownership of any custom survey questions you create and the clinical data you collect through the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy, reliability, or clinical validity of any survey responses collected through the Service. The Service is a supplementary tool and should not replace professional clinical judgment. We are not responsible for treatment decisions made based on data collected through the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Psycontext shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, clinical outcomes, or business interruption.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to access the Service ceases immediately. Data retention and deletion policies in our Privacy Policy continue to apply.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
